USCIS announced March 8th that they are publishing a new Form I-9, Employment Eligibility Verification. This new form (with a revision date of 3-8-2013) will have a 60 day implementation period during which time both the new and old form versions may be used. However, after May 7, 2013, only the new Form I-9 may be used.

A new Form I-9 was proposed last year and USCIS received several thousand comments from the public regarding the proposed changes. The new Form I-9 is completely different than previous versions beginning with a significant change from one to two pages and the addition of extra data fields. Even if you have been completing the I-9s for some time, there are going to be a lot of questions with the emergence of this new form. We would suggest continuing to use the old form at least until you have a chance to fully review the changes and understand what is required.
During the presentation, Attorney Sharon Mehlman will guide you through the new form line by line and then answer any questions that you may have about the changes. Note that if you are using an electronic I-9 system, the I-9 vendors should be aware of the change and will be working on the new form for the electronic process. However, if the new form is not ready for your electronic system, you should be prepared to use paper forms in the interim.
As a reminder, the new Form I-9 will be required for all new hires (you are not required to redo the I-9s for existing employees) and for any rehires or re-verifications when you would normally use section 3. The Spanish version of the new form will still only be valid for use in Puerto Rico.
